You could end up with the case not being filed if the dollar amount of the theft is too low for the prosecutors standards. It is possible that your attorney can negotiate a diversion type resolution for you. If you successfully complete the terms of your diversion, then you would end up with a clean criminal record in the end. There are other potential outcomes that could protect your record as well. Your attorney could negotiate a deferred entry of judgment type resolution, where you plead guilty to the charged, but are not sentenced by the judge. In this type of disposition, the sentencing is continued for a period of time and you are ordered to complete certain conditions. If you complete what the judge orders you to, then the case would be dismissed and your record protected.
Of course, the case could go to trial and you could be found not guilty. Last, your attorney could work out a deal where you plead guilty and are sentenced to a misdemeanor petty theft and given certain terms and conditions of probation, which could include jail time, community service, cal trans, a fine and a stay away from the location of arrest order. As you can see, there are many different potential outcomes…this is why the attorney you choose to represent you is so important. The potential dispositions I have outlined above are the most common outcomes for petty theft cases that I have seen over the past 20 + years of negotiating and litigating thousands of criminal cases in the many Los Angeles courthouse.

Once you go meet with the attorney at their office and ask them about themselves and what they think about your situation, you will have a good feel for whether this is the person you want protecting your rights, freedom and reputation.

A theft crime classified as petty theft is when a person unlawfully takes the property of another with the intent to deprive permanently. The property unlawfully taken is valued less than $400. Generally, petty theft is considered a misdemeanor and is punishable with a jail term of up to six months and/or a fine of no more than $1,000.
If the value of the money, labor, real or personal property taken does not exceed fifty dollars ($50), the petty theft may be charged as a misdemeanor or an infraction, at the discretion of the prosecutor, provided that the person charged with the offense has no other prior theft or theft-related conviction.
Under certain circumstances a pretty theft may be charged as a felony offense. For example, a second petty theft conviction may result as a felony conviction and carry a prison sentence of up to 12 months.
